The Sub-Committee has considered all the relevant evidence made available to it and in doing so has taken into account the Licensing Act 2003, the Guidance issued by the Secretary of State under Section 182 of the Act , the Council’s Statement of Licensing Policy and Licensing objectives.  The Council has also taken note of recent Court Rulings requiring that where conditions are to be imposed the same should be discussed with the license holder. 

 

The Sub-Committee has decided, on the balance of probabilities to grant the application subject to the following conditions:

 

1)         The premises shall be licensed for the sale of alcohol by retail and recorded music from 09h00 to 24h00 hours from Sunday to Wednesday and from 09h00 hours until 24h30 from Thursday to Saturday.  

            Live music, and the provision of facilities for music and dancing shall be licensed from 18h00 until 24h00 hours on a Sunday to Wednesday and from 18h00 until 24h30 from Thursdays to Sundays.

            Late night refreshments shall be licensed from 23h00 until 24h00 hours from Sunday to Thursday and from 23h00 until 24h30 on Thursday to Saturday. 

2)         The steps outlined in the application to uphold licensing objectives I accepted fully as conditions of the license.

3)         Patrons shall be permitted 30minutes winding down time prior to the closure of the premises.
