Consideration of the report as below.

 

 

The Sub-Committee has considered all the relevant evidence made available to it and in doing so has taken into account the Licensing Act 2003, the Guidance issued by the Secretary of State under section 182 of that Act, the Council’s Statement of Licensing Policy and the Licensing objectives has come to the following decision:

 

(1)  The Premises Licence shall be suspended for a period of 3 months;

(2)  The suggestions and recommendations made by Metropolitan Police and accepted by Mr Obhrai are accepted as conditions of this licence subject to the amendments listed below:

a.      The Designated Premises Supervisor shall ensure that the 6 cameras mentioned are operational and switched on during all trading hours;

b.     There shall be two(2) trained adult persons on duty in the shop during all trading hours;

c.      All staff to undergo to undergo training regard identity and challenging sales/persons not permitted to buy and potential underage drinking within 21 days of this decision coming into effect.  Written proof that such training has been undertaken must be provided to the Licensing Officer.

  For ease of reference, the conditions originally agreed to by the Metropolitan Police Services and Mr Obhrai is attached marked to this document marked Appendix A.

(3)  The Designated Premises Supervisor shall undergo advanced licensing training suitable to a Designated Premises Supervisor with an external trainer.  Proof of attendance of such a course will be provided to the Licensing Officer;;

(4)  Mr Obhrai testified that his shop trades between 09h00 and 21h30 hours.  The times that World Wines may carry out licensable activities is therefore varied as follows:

a.      Monday to Sunday between 09h00 and 21h30 hours;

b.     On Good Friday between 08h00 and 22h30 hours;

c.      On Christmas Day from 12h00 until 15h00 and from 19h00 until 22h30 hours
