Apologies had been received from Cllr Carol Melvin, and Cllr Peter Kemp substituted. Apologies had also been received from Cllr Lynne Allen.

This was an application for the a review of a Premises Licence under Section 51 of the Licensing Act 2003 in respect of West Drayton Food & Wine, 19 Station Road, West Drayton UB7 7BT.

 

Decision:

The Sub-Committee had considered the application and taken into account evidence and submissions from all of the parties. In reaching its decision the Sub-Committee had taken into account the relevant provisions of the Licensing Act 2003, the Secretary of State’s Guidance issued under the Act and the Council’s Statement of Licensing Policy.  The Sub-committee had also taken into account its overriding duty to promote the Licensing Objectives. 

 

The Sub-Committee had decided, on a balance of probabilities, to REVOKE the license.

 

The Sub-Committee had arrived at this decision for the following main reason:

The Licence holder knowing purchased counterfeit goods and sold these on the premises.

 

The Licence holder breached an array of conditions of his license including not correctly display alcohol or signage.

 

The Licence holder had failed to uphold the Licensing Objectives by engaging in criminal and unlawful activity.

  

No decision made by the Council would have effect during the time period within which an appeal may be brought and until such time that any appeal had been determined or abandoned.
