It was confirmed that all items for business were to be considered in Part 1, public.

Matters that have been notified in advance as urgent

Minutes:

Mr Dadds, solicitor acting on behalf of Mr Amarjeet Singh, requested the sub-committee adjourn for 15 minutes so he could consider papers that had been served to him by Sgt Meens. This request was granted by the sub-committee.

Consideration of the report from the Council's Licensing Officer

Minutes:

This was an application for the grant of a Premises Licence that would authorise the use of the premises of 75 Station Road Hayes by Mr Amarjeet Singh to supply alcohol.

 

Decision:

The Sub-Committee had considered the application and taken into account evidence and submissions from all of the parties. In reaching its decision the Sub-Committee had taken into account the relevant provisions of the Licensing Act 2003, the Secretary of State’s Guidance issued under the Act and the Council’s Statement of Licensing Policy.  The Sub-committee had also taken into account its overriding duty to promote the Licensing Objectives. 

 

The Sub-Committee had decided, on a balance of probabilities, to REJECT the application.

 

The Sub-Committee had arrived at this decision for the following main reason:

 

The Sub-committee is not satisfied that the applicant appreciates the responsibilities that attach to being granted a premises licence.  Additionally, as matters stand, the Sub-committee is not satisfied that the applicant has sufficient understanding of how to promote the licensing objectives responsibly.

 

The Sub-committee asked that it be noted that it resented the patronising attitude with which it had been addressed by the applicant’s solicitor. The Sub-committee was fully trained in the licensing objectives and in knowing what information it received was relevant or otherwise.

 

No decision made by the Council would have effect during the time period within which an appeal may be brought and until such time that any appeal had been determined or abandoned.
