Minutes:

Members considered details of a complaint of alleged misconduct made against an elected Member of the Council. In doing so, and in accordance with the Standard Committee Procedure Rules, Members, first of all, confirmed that the complaint was against one or more named Members of the Council and that that Member was in office at the time of the alleged misconduct and the Code of Conduct was in force at that time.

 

Members then gave consideration to whether, if proven, the alleged misconduct would be a breach of the Code of Conduct under which the Member was operating at the time.

 

The Committee unanimously decided that it was not satisfied that the complaint, if proven, would be a breach of the Code of Conduct under which the Councillor was operating at the time of the alleged misconduct. The Committee noted that the Nolan principles underpin the Code of Conduct, but they do not actually form part of the General obligations set out in the Code.

 

In the circumstances, the Committee did not proceed to assess the validity of the complaint and

 

RESOLVED: That no action be taken in relation to the complaint.
