Licensing Officers presented this item. Officers informed the Committee that on 6th January 2010 the Department for Culture, Media and Sport published a consultation on their web site in respect of a proposal to introduce a legislative reform order which will amend the Licensing Act 2003 to exempt small live music events from the Licensing Act 2003. The closing date for the consultation was 26th March 2010. The government proposes to exempt from the Act small live music events in licensed and unlicensed premises subject to the following:

 

1.      That the performance takes place within a permanent building;

2.      That the audience does not exceed more than 100 people;

3.      That the performance does not take place between 11pm and 8am; and

4.      The performance does not take place in a premises which is subject to an ‘exclusion’ decision.

 

The reform order also proposed to overturn any public nuisance prevention conditions which had been imposed in relation to regulated entertainment. Licence holders would be invited to vary their licences to remove such conditions.

 

The Council’s Environmental Protection Unit Officers expressed concerns over such measures being introduced.

 

The Committee expressed their reservations over the “total exemption of small live music events from the Licensing Act 2003” as proposed by his consultation. Members felt this move would take away all control from the Licensing Authority.

The Committee agreed that the Licensing Service Manager would draft a response to the DCMS containing the Committee’s rejection of this proposal.
