Consideration of the report from the Council's Licensing officer Minutes: The Sub-Committee considered the report and made their decision as follows:
DECISION
The Sub Committee had considered all the relevant evidence made available to itand in doing so had taken into account the Licensing Act 2003, the Guidance issued by the Secretary of State under Section 182 of the Act , the Council’s Statement of Licensing Policy and Licensing objectives. The Sub-Committee had also taken note of recent Court Rulings requiring that where conditions were to be imposed the same should be discussed with the license holder.
The Sub Committee decided, on the balance of probabilities to grant the application subject to the following conditions:-
1. The conditions stipulated by the Environmental Protection Unit be introduced as conditions of the license and shall be implemented on or before 18 December 2009; 2. The supply of alcohol shall be licensed on Friday and Saturday from mid-day until 23h00 and on Sundays from 10h00 until 16h00. 3. No supply of alcohol shall be made under the Premises License at a time when there is no designated premises supervisor or his nominee present. Any nominee shall hold proof of such nomination in writing from the designated premises supervisor. 4. All stewards present on the ground during any event shall be trained to SIA standards on or before 18 December 2009. For the avoidance of doubt, it is clarified that from 18 December 2009 onwards, all persons identified as stewards in the licence application must carry SIA registration when carrying out duties at the Great Barn. 5. The designated premises supervisor shall hold up-to-date records of all stewards holding SIA registrations; such record shall be available for inspection by responsible authorities. 6. All drinks shall be served in non-glassware drinking vessels. No alcoholic drinks shall be served in bottles. 7. The conditions offered by the applicant in the operating schedule are accepted as conditions of the license subject to the following variations: a. The maximum number of persons permitted to be present at an event held at the Great Barn shall not exceed 350 people. 8. The premises shall be cleared of patrons and closed 30 minutes after the conclusion of the last licensed activity. For the avoidance of doubt, this means that the venue will be closed and all patrons or attendees shall have left the premises of the Great Barn within 30 minutes of the last licensable activity.
