Apologies for absence had been received from Councillor Judy Kelly.  Councillor Peter Kemp was present as a substitute.

The Licensing Officer introduced the report in respect of an application for a Premises Licence for Premises Licence for Warley Road Food and Wine, Hayes for the provision of the sale of alcohol.

 

Representation in respect of the application had been received from residents, in the form of a petition and a letter, under the four Licensing objectives listed below:

  • The Prevention of Crime and Disorder
  • Public Safety
  • The Prevention of Nuisance
  • The Protection of Children from Harm

 

Objections from the Metropolitan Police Service had been withdrawn, as the applicant had accepted the recommended conditions set out in their letter of representation.

 

Following deliberation, the Sub-Committee unanimously agreed that the information made available was insufficient for Members to determine the application.

 

The Sub-Committee deferred the application on the grounds of Lack of clarity on crime and disorder issues.

 

The following information was therefore requested:

 

1)                 Updated map and layout of store from the applicant

2)                 Crime and disorder statistics from the Metropolitan Police Service.

 

The Sub-Committee considered that this information was relevant when determining Licensing hours and any conditions that may be attached to the Licence.

 

The item was therefore deferred until Friday 1 February 2013 for further information.

 

Decision – that the application be deferred until Friday 1 February 2013 for the following information:

 

1)     Updated map and layout of the store from the applicant

 

2)     Crime and disorder statistics from the Metropolitan Police Service.

Personal Licence Application

Minutes:

The Licensing Officer introduced the report relating to an application for a Personal Licence under Part 6, section 117 of the Licensing Act 2003 by Mr DLH.

 

The applicant was not present at the meeting.

 

Decision

 

The Sub-Committee considered this application. In reaching its decision, the Sub-Committee took account of the relevant provision of the Licensing Act 2003, the Secretary of State’s Guidance issued under the Act and the Council’s Statement of Licensing Policy. The Sub-Committee also took into account its overriding duty to promote the prevention of crime and disorder objective. In doing so, the Sub-Committee decided to reject the application.
