The Council's Licensing Officer presented the report to the Sub-Committee.

 

Stephanie Waterford, Senior Licensing Officer stated that an application to vary the premises licence for the Three Steps at the Coachmans Inn was received on 11th July 2014 from Fortis Rose Solicitors, Edmonton, London on behalf of the premises holder, Mr Erhan Sahin.

 

The application concerned a request to extend the sale of alcohol, the provision of regulated entertainment live music, recorded music and late night refreshments. The application also included the requests to extend the hours the premises were open to the public and to remove a condition under Annex 2 of the current licence which pertained to the use of the patio area at the premises after 23:00.

 

The application was advertised in the correct way, as set out in the Licensing Act 2003. Following the advertisement, representations were received from the following interested parties:

 

All three Ward Councillors

The Metropolitan Police Service

The Environmental Protection Unit

Eleven local residents.

 

 

The Sub-Committee considered all the relevant evidence made available to it and in doing so took into account the Licensing Act 2003, the Guidance issued by the Secretary of State under Section 182 of the Act, the Council's Statement of Licensing Policy and Licensing objectives. The Sub-Committee carefully considered its decision, taking into account the demands of the legislation:

 

 

DECISION

The Sub-Committee has considered all the relevant representations made available to it and in doing so has taken into account the Licensing Act 2003, the Guidance issued by the Secretary of State under Section 182 of that Act, the Council’s Statement of Licensing Policy, the Licensing objectives and the Public Sector Equality Duty.  The Licensing Sub-Committee has come to the following decision:

 

The decision of the Sub-Committee is to vary the premises licensable activities times for:

·                Recorded music Thursday to Saturday from 11.00 to 01.30 the following day

·                Live music Thursday to Saturday from 11.00 to 01.30 the following day

·                Sale of Alcohol Thursday to Saturday from 07.00 to 02.00 the following day

·                Late night refreshment Thursday to Saturday from 23.00 to 02.00 the following day

 

And to vary premises opening hours: Thursday and Saturday between 07.00 hours and 02.30 hours the following day.

 

All other opening hours and times for licensable activities are to remain as per the existing licence.

 

In addition, the Sub-Committee determined to add the following additional conditions to the premises licence:

 

·                A sound limiting device shall be installed in accordance with the manufacturer's instructions, and shall be attached to all sound amplification equipment used on the premises. The device shall be located in a lockable cabinet and set at a level to the satisfaction of the Environmental Protection Unit. The limiter shall not be altered without prior agreement from the Environmental Protection Unit. The sound limiting device shall be designed to activate a visual warning and prevent any increase in volume once the pre-determined sound limit has been reached.
