RESUMING: Application for a Review of Premises Licence: Krishna Cash and Carry, 704 - 708 Uxbridge Road, Hayes, UB4 0RX

The hearing resumed on Monday 24 September 2018 at 10 am.

 

The Decision

 

The Sub-Committee has considered all the relevant evidence made available to it and in doing so has taken into account the Licensing Act 2003, the Guidance issued by the Secretary of State under Section 182 of the Act, the Council’s Statement of Licensing Policy and Licensing objectives. 

 

The decision of the Sub-Committee is to suspend the premises licence for a 3 month period:

 

The sub-committee gave very serious consideration to revoking the premises licence, but on balance the sub-committee considered that the licencing objectives were best upheld, by suspending the licence and attaching the following additional conditions to the licence:

 

1.            No part of the premises are to be sub-let;

2.            All staff must be employed by and only by the premises licence holder;

3.            The Premises Licence Holder shall engage the services of an Independent Licensing Consultant to undertake unannounced spot checks on the premises on a monthly basis for a period of 2 years;

4.            The report of the Independent Consultant following each visit shall be submitted to the Council, within 5 working days of the visit taking place;

5.            Personal Licence Holder must be on the premises at all times when licensable activities are taking place;

6.            The Premises Licence Holder shall attend and complete a Level 2 course operated by the BIAAB for DPS’s within 3 months and provide the Council with a copy of his certificate on completion;

7.            There will be a Challenge 25 policy operating at the premises. Challenge 25 means that the holder of the premises licence shall ensure that every individual, who visually appears to be under 25 years of age and is seeking to purchase or be supplied with alcohol  at the premises or from the premises, shall produce identification proving that individual to be 18 years of age or older. The form of identification shall contain their photograph, date of birth and a holographicmark.

 

Right of Appeal

 

No decision made by the Council will have effect during the time period within which an appeal may be brought and until such time that any appeal has been determined or abandoned.

 

The relevant applicant for the premises licence or any other person who made relevant representations to the application may appeal against the Council’s decision to the Justice Clerk at the Uxbridge Magistrates Court.  Such an appeal may be brought within 21 days of receipt of this Notice of Decision.

 

The Premises Licence Holder will be deemed to have received the Decision Notice, two days after the date on the accompanying letter, which will be posted by 1st class mail.
