Application for a Review of a Premises Licence - Bar 101, 101-103 High Street, Ruislip, HA4 8JN

Minutes:

The hearing began 15 minutes late in order to afford the Responsible Authorities an opportunity for final discussions with the Premises Licence Holder. The Chairman of the Committee advised that due to the complexity of discussing the Part I and Part II aspects separately, he proposed hearing the application entirely in Part II. The panel agreed to hold the meeting in Part II by virtue of paragraph(s) 1, 2, 7 of Part 1 of Schedule 12A of the Local Government (Access to Information) Act 1985 as amended.

 

The Decision

 

RESOLVED: That:

The Sub-Committee has considered all the relevant evidence made available to it and in doing so has taken into account the Licensing Act 2003, the Guidance issued by the Secretary of State under Section 182 of the Act, the Council’s Statement of Licensing Policy and Licensing objectives. The decision of the Sub-Committee is to modify the conditions of the premises licence as follows:

 

1.    The sale of alcohol is licensed between 12h00 and midnight on Sundays; between 10h00 and midnight Monday-Thursday; between 10h00 and 01h00 the following day on Fridays and Saturday.

2.    The provision of late night refreshment is licensed Sunday-Thursday between 23h00 and midnight ; on Fridays and Saturdays between 23h00 and 01h00 the following day.

3.    The premises shall close everyday 30 minutes after licensable activity ends.

4.    The provision of regulated entertainment is removed as a licensable activity.

5.    Special events shall be licensed only for New Years Eve until the end of business on New Years day.

6.    Conditions 1,3,4,10,11,13 suggested by the Metropolitan Police as reflected on page 27 of the Agenda pack are accepted as conditions of the licence. These conditions are:

a.    A television monitor shall be installed at the entrance to the premises showing the faces of customers as they enter the premises. The screen shall be so positioned as to render it evident to customers entering the premises that their image is being captured on CCTV.

b.    All door supervisors employed at the entrance/exit of the licensed premises will wear high visibility clothing.

c.    As soon as possible, and in any event within 1 month from the grant of this licence, the premises shall join the local Pubwatch or other local crime reduction scheme approved by the police, and local radio scheme if available.

d.    Queuing outside the premises shall be restricted to a designated area agreed with the Metropolitan Police Services. The designated queuing area shall be enclosed within appropriate barriers to ensure that the footway is kept clear.

e.    Any queue to enter the premises that forms outside the premises shall be kept orderly and supervised by licensed door supervisors to ensure that there is no public nuisance or obstruction to the public highway.

f.     The premises shall display prominent signage advising patrons of the times during which licensable activity may take place.

7.    A challenge 25 scheme shall be implemented to ensure that any patron that appears to be under the age of 25 shall provide proof that he/she is over the age of 18.

8.    A maximum total of 20 persons shall be permitted to use the designated smoking area at any one time.

9.    A random search policy shall be implemented on entry or re-entry to the premises. Appropriate signage shall be in place to indicate random searches shall take place.

10.  On Thursday-Sunday, a personal licence holder shall be on the premises at all times that licensable activity is taking place.

11.  There shall be a procedure agreed with the Metropolitan Police Service Licensing Officer relating to the storage and/or disposal of illegal drugs, weapons and other prohibited items found on the premises or found on persons attempting to enter the premises.

12.  The premises licence holder shall develop and implement a full search policy. Staff and door supervisors shall receive regular training regarding this policy. On Fridays, Saturdays and "Special Event" nights i.e. New Years Eve, all persons entering and re-entering the premises shall be searched by door supervisors, to include full bag search and body "pat down" searches to prevent weapons, drugs or other prohibited items from being brought onto the premises.

13.  A minimum of 2 Door Supervisors shall be on duty on Fridays and Saturdays from 21h00 until all patrons have left the premises and are dispersed from the area. Door Supervisors shall be visible and shall wear clothing which easily identifies them as such.

14.  The premises licence holder shall develop a wind-down and dispersal policy. The policy shall include steps to promote the safe and orderly dispersal of patrons from the premises. A copy of this policy shall be provided to the Licensing Authority within 3 months of the date of this hearing.

15.  No drinks shall be taken outdoors from 22h00 until the close of premises daily.

16.  A capacity limit of 160 persons is imposed on the premises.

17.  Sufficient tables and chairs shall be provided to seat 80 persons at any one time.

18.  There shall be a register of all complaints received from residents which shows how the complaint was addressed.

19.  Notices requesting customers to leave quietly shall be displayed both inside and outside the premises.

20.  Public transport information shall be made readily available to patrons; including taxi firms. Notices displaying this shall be affixed in a prominent position for patron information.

21.  An incident log shall be maintained at the premises and shall be made available on request by the Metropolitan Police or an authorised officer from the London Borough of Hillingdon.
