THE DECISION
The Sub-Committee has considered all the relevant evidence made available to it and in doing so has taken into account the Licensing Act 2003, the Guidance issued by the Secretary of State under Section 182 of the Act, the Council’s Statement of Licensing Policy and Licensing objectives. The Sub-Committee has carefully considered its decision taking into account the demands of the legislation.
The Sub-Committee's decision is to:
1. Suspend the premises licence for a period of eight weeks; and
2. Remove Mr Jasmeet Singh as the designated premises supervisor; and
3. The following conditions shall be attached to the premises licence:
1. No alcoholic drinks or tobacco shall be purchased by the premises from unannounced sellers calling at the premises;
2. All alcohol and tobacco products shall be purchased from established and bona fide VAT registered traders, which shall provide invoices or receipts;
3. Invoices for all stock bought shall be kept on file for a minimum of 6 years and shall be made available to the Police, HMRC Officers and Authorised Local Authorities Officers upon request;
4. The premises shall be protected by a Closed Circuit Television System (CCTV) with a minimum of five cameras of which:
a. One camera shall capture the counter;
b. One camera shall capture the head and shoulders of persons entering the store;
c. One camera shall show the main area of the shop;
d. One camera shall show the area immediately outside the front entrance of the shop;
All areas where alcohol is displayed must be in clear view of the cameras and the counter. All CCTV locations shall be approved and agreed in writing by the Metropolitan Police;
5. All images of the cameras shall be retained for 31 days and shall be made available to the Police and Local Authority upon request;
6. A monitor showing one or more of the CCTV images shall be positioned so that it is visible to customers and staff in the till area;
7. If the CCTV system should, at any stage, fail to operate and record properly then the Police Licensing Office and Licensing Authority should be promptly notified in writing and the defect rectified as soon as possible;
8. There shall be two adult persons on duty in the shop from 19:00 hours until the close of business everyday;
9. No alcoholic products shall be displayed within 2 meters from any access point of the shop;
10.Products containing alcohol above 35% ABV shall be stored behind the counter;
11.The till should be placed under the counter or if located on top of the counter the till shall be fixed into a position so that it cannot be easily removed;
12.The Premises shall operate a challenge scheme and should be minded that the London Borough of Hillingdon supports the 'Challenge 25 scheme' and a log of all refusals shall be kept and made available for all relevant authorities to inspect upon request; and
13.Notices shall be displayed to request customers to leave quietly.
