The Licensing officer introduced the report and provided an update on the application, which had been deferred from the meeting held on the 22 October 2014, to enable a full licence compliance check to be carried out. 

 

The Sub-Committee received update reports on the two compliance checks carried out and were informed that most of the licensing conditions had now been met.  Officers advised Members that there were still minor breaches but revocation was no longer being sought. The Sub-Committee was advised that any changes to the layout of the shop would need to be registered with the Licensing Authority.

 

The License holder addressed the Sub-Committee and explained that a number of the breaches of the licensing conditions had now been met.  Since the last compliance check was carried out all alcohol above 35 abv had been moved behind the counter and the floor behind the counter had been raised.  Photographs were circulated to confirm this information.  Members were informed that there had been a witness to the conflict between the licence holder and her mother and a written letter to verify this had been provided. 

 

The members still had concerns around the issue of the CCTV and the fact that it had not been in operation correctly since the licence had been granted in 2007.   They highlighted that it was the responsibility of the license holder to ensure that this was in place in accordance with the conditions of the licence.

 

In answer to a question raise in relation to the door to the counter area being temporary, the license holder advised that she was not in a position financial to improve this at the moment.

 

Members still had concerns that from the photographs provided there was still some alcohol above 35abv that was not behind the counter and the previous management issues that had led to the review being sought in the first place.

 

Each party gave their closing remarks following which all parties were asked to leave the room whilst the sub-committee made their decision.

 

Following deliberations, the Sub-Committee unanimously agreed to suspend the licence for 6 weeks to enable the remaining breaches of the licensing conditions to be addressed.

 

Officers, the Responsible Authority, Police and the License holder were invited back into the meeting to be advised of the Sub-Committee's decision by the Chairman.

 

Resolved - That the Licence for the Ruislip Superstore be suspended for 6 weeks.
