Application for a Review of a Premises Licence - Costcutter, 10-12 Coldharbour Lane, Hayes, UB3 3EW

Minutes:

Mr Ian Meens, Licensing Officer at the London Borough of Hillingdon, introduced the report relating to a premises licence review application.

 

This application had been initiated by the Metropolitan Police Service and Trading Standards and it sought a review of the Premises Licence of a premises licensed as Costcutters, 10-12 Coldharbour Lane, Hayes on the grounds of Prevention of Crime and Disorder. 

 

This item is included in Part II as it contains information relating to an individual or likely to reveal the identity of an individual and Information relating to any action taken or to be taken in connection with the prevention, investigation or prosecution of crime and the public interest in withholding the information outweighs the public interest in disclosing it (exempt information under paragraphs 1, 2 and 7 of Part 1 of Schedule 12A to the Local Government [Access to Information] Act 1985 as amended.

 

The Decision

 

RESOLVED:  That the Sub-Committee had considered all the relevant evidence made available to it and in doing so has taken into account the Licensing Act 2003, the Guidance issued by the Secretary of State under Section 182 of the Act, the Council’s Statement of Licensing Policy and Licensing objectives. 

 

The decision of the Sub-Committee is to revoke the licence.

 

The licence holder has not demonstrated that he is able to manage the premises in a manner which upholds the licensing objectives.  The addition of conditions and a change of DPS will not be effective because Mr. S. will continue as owner and therefore be in a position to direct the actions of the new DPS.   The proposed new DPS has not demonstrated the knowledge of the licensing objectives and the conditions attached to the current premises licence.  The Sub-Committee is particularly concerned that she indicated that the shop could carry out on sales, when specific conditions currently on the licence prevent, on sales.  This indicates that she does not have the skill necessary to manage the premises in a manner which upholds the licensing objectives.
