It was confiremd that agenda items 1-4 were Part I and would be heard in public, while item 5 was Part II, and would be heard in private.

Matters that have been notified in advance or urgent

Minutes:

The Licence Holder was accompanied at the hearing by his designated representative. At the commencement of the hearing, the representative requested that the hearing be adjourned as he had been appointed by the Licence Holder on Friday 20 April, and this had not provided him with sufficient time to prepare for the case.

 

The request was considered by the Chairman, who ruled that the licence holder had received sufficient time to prepare for the hearing, which included the appointment of any representation. Furthermore, the Chairman was mindful of the Sub-Committee’s duty to protect the residents of Hillingdon. The Chairman therefore ruled that the hearing would continue as scheduled, though would accept the submission of any supporting documents and evidence from the licence holder and his representative.

Application for a Review of a Premises Licence - 'UR Local' at 6 Dawley Parade Hayes UB3 1EA

Minutes:

Ian Meens, Licensing Officer at London Borough of Hillingdon introduced the report, photographs and addendum relating to a review of the premises licence for UR Local at 6 Dawley parade, Hayes UB3 1EA.

 

The Decision

 

The Sub-Committee considered all the relevant representations made available to it and in doing so took into account the Licensing Act 2003, the Guidance issued by the Secretary of State under Section 182 of that Act, the Council’s Statement of Licensing Policy and the Licensing objectives.  The Sub-Committee paid particular attention to S144 of the Licensing Act 2003 read together with Paragraphs 11.23, 11.27, 11.28 of the S182 Guidance issued by the Secretary of State.  The Licensing Sub-Committee determined that it was necessary and proportionate to revoke the premises licence for Madhans AM2PM Limited.

 

Right of appeal

 

No decision made by the Council will have effect during the time period within which an appeal may be brought and until such time that any appeal has been determined or abandoned.

 

The applicant for review, holder of the Premises Licence, or any other person who made relevant representations to the application may appeal against the Council’s decision to the Justice Clerk at the Uxbridge Magistrates Court.  Such an appeal may be brought within 21 days of receipt of this Notice of Decision.

 

The Licence Holder will be deemed to have received the Decision Notice, two days after the date on the accompanying letter, which will be posted by first class mail.
