The Licensing Officer introduced the report in respect of an application for a Premises Licence for West Drayton Convenience Store, 18 Station Road, West Drayton, UB7 7By, for the provision of the sale of alcohol.

 

A representation in respect of the application had been received from the Metropolitan Police Service under the ‘Prevention of Crime and Disorder’ and the ‘Public Safety’ Licensing Objectives. Representation had also been received from the delegated officer on behalf of the Licensing Authority in respect of the ‘Public Safety’ Licensing Objective.

 

Decision

 

In reaching its decision, the Sub-Committee considered all the relevant evidence that had been made available; it took into account the Licensing Act 2003, the Guidance issued by the Secretary of State under Section 182 of the Act, the Council’s Statement of Licensing Policy and the Licensing Objectives. It also considered the representations of the Metropolitan Police Service and the Licensing Authority, as well as the submissions of the applicant and new documents put forward in support of the application.

 

The Sub-Committee decided to grant the Premises Licence subject to the conditions proposed in the schedule submitted by the applicant and imposed the following conditions from those suggested by the Metropolitan Police Service:

 

·        There shall be two adult members of staff on the premises between 19.00 hours until the close of business each day.

 

·        All alcohol products shall be stored in direct line of sight from the cashier’s position and not obscured by other displays or shelving.

 

·        Products with an ABV above 35% shall be stored behind the counter.

 

·        The till shall be placed under the counter or if on the counter, shall be fixed into position so that it cannot be easily moved.

 

·        The CCTV system shall be kept in good working order. One camera shall be positioned to record all transactions at the counter, a second in the area where alcohol is displayed, a third to record the head and shoulders of all persons entering the premises and a fourth to record the area immediately outside the main entrance to the premises.

 

·        The premises licence holder shall ensure that all CCTV recordings shall be stored for a minimum of 28 days with the date and time stamping. Recordings shall be made available on reasonable request by Police or Local Authority officers throughout the 28 day period. The premises licence holder shall ensure that a staff member from the premises who is conversant with the operation of the CCTV system shall be on the premises at all times when the premises are open to the public.

 

·        A monitor showing one or more of the CCTV images shall be positioned so that it is visible by customers and staff at the till area.

 

·        The counter shall be a minimum distance of one meter from the floor and at least 60cm deep. Access behind the counter shall be via a door bolted from the inside. The floor behind the counter shall be raised at least 10cm above the normal floor level.

The Licensing Officer introduced the report in respect of an application for a Premises Licence for Bhudda Lounge, Dawley Road, Hayes, UB3 1EN, for the sale of alcohol, provision of regulated entertainment and provision of late night refreshments.

 

Representations in respect of the application had been received from the Metropolitan Police Service, a Ward Councillor and 4 local residents under the four Licensing objectives listed below:

 

  • The Prevention of Crime and Disorder
  • The Protection of Children from Harm
  • Public Safety
  • The Prevention of Nuisance.

 

Decision

 

In reaching its decision, the Sub-Committee considered all the relevant evidence that had been made available; it took into account the Licensing Act 2003, the Guidance issued by the Secretary of State under Section 182 of the Act, the Council’s Statement of Licensing Policy and the Licensing Objectives. The Sub-Committee also considered the submissions of the applicant, representations of the Metropolitan Police Service, the Ward Councillor, as well as letters submitted by 4 residents.

 

The Sub-Committee decided to grant the Premises Licence subject to the mandatory conditions, and attached the following additional conditions including those suggested by the Metropolitan Police Service:

 

  1. There shall be fitted a CCTV system which has been approved by police and which is capable of retaining images for a period of 30 days. A copy of the images shall be given to the police or local authority on request and without charge. The system shall be  operational during the whole period  that the premises is open for business and should the system fail then the premises shall not operate any licensable activities.

 

  1. When entertainment is by way of music for dancing, there shall be a minimum of 2 door supervisors on duty from 19.00 hours until 10 minutes after the last customer has left the building.

 

  1. The police shall be informed of events promoted by any outside promoter via Form 696 and in accordance with the Council’s Statement of Licensing Policy.

 

  1. There shall be maintained an incident book within which shall be entered the names and badge numbers of all door staff on duty and the time of and summery of any incidents, the names if known or description of persons ejected, any incidents of assaults and disorder, when alcohol has been refused and for what reason and the seizure of any weapons or drugs.

 

  1. Seized illegal weapons or drugs shall be stored securely until collected by the police.

 

  1. Only persons over 21 shall be permitted after 00.00hrs unless it is a pre arranged private function.

 

  1.  No alcohol must be taken out to or consumed in the area indicated on the plans as the outdoor smoking area.

 

  1. Signs shall be erected in prominent locations close to all exits asking patrons to leave the premises quietly and to respect the neighbours.

 

  1. Alcohol shall only be sold during the following hours:

 

11.00 hours until 23.30 hours, Sunday to Thursday

11.00 hours until 00.30 hours, Friday and Saturday.
