Consideration of any Call-Ins of Decisions Made at the Cabinet Meeting held on 29 September 2011

To hear the Call-In of any decision made at the Cabinet meeting prior to this meeting or made by Cabinet Members, other Council Committees or a delegated officer and published within five working days of this meeting.

 

Members should bring their Cabinet agenda to the meeting.

 

Members should consider any other decision published in the five working days before this meeting.

 

The purpose of this meeting is to decide whether to refer back any decision to the decision maker.

Minutes:

Members gave consideration to the Cabinet reports of 29 September 2011 and after careful consideration Members decided not to call-in any decision made by the Cabinet at their meeting.

 

However, the Committee requested further information and clarification on the following Cabinet reports:-

 

Cabinet Agenda Item 6 - Queens Walk Learning and Development Centre

 

On page 63 of the agenda reference was made to provisionally transferring these events subject to Cabinet approval to Adult Learning Centres across the Boroughs. One centre was listed as Stockley. Members asked if this would be at Stockley Academy?

 

[Subsequent to the meeting, officers provided the following response:

 

“The proposal would be for a centre on part of the Stockley Academy site on Park View Road.”]

 

Cabinet Agenda Item 7 - Transformation of Adult Social Care - Personalisation and Commissioning Plan 2011-2015

 

On page 88 of the agenda under the paragraph headed "Older People" the third bullet point, "of the current older people population 89% are White, 7.5% Asian and only 1.6% Black".

 

Members asked for clarification on this breakdown and was this referring to over 65's or 85's?

 

[Subsequent to the meeting, officers provided the following response:

 

“The ethnic breakdown referred to the over 65 population and was as follows:

White 89%, Asian 7.5%, Black 1.7%, Chinese or other 0.8% and Mixed race 0.7%. This came to 99.7% due to rounding up.”]

 

Cabinet Agenda Item 8 - Disabilities Commissioning Plan 2011-2015

 

Members asked when was the consultation with service users and other stakeholders due to start and finish.

 

[Subsequent to the meeting, officers provided the following response:

 

“The consultation with service users and other stakeholders started on 3 October 2011 and was due to end in mid December. The outcome of the consultation would be reported to Cabinet in January 2012.”]

 

Cabinet Member Decision on the Council petition to allow the Ramgarhia Sikh Association Hayes to purchase the former Golden Crescent Library in Hayes: consideration of response following Council resolution

 

The Leader of the Opposition requested that the Chairman of the Committee give consideration to calling in the above recently published Cabinet Member Decision. Members were reminded that under the Rules of Procedure for Call-Ins, decisions made by Cabinet Members, can be called-in by agreement of the Chairman of this Committee and the lead representative of the Opposition Group on the Committee within 5 working days of the decision being published. This decision was published on 23 September 2011 and was therefore within the time frame.

 

A discussion took place amongst Members in relation to the decision. The lead representative of the Opposition Group on the Committee expressed concern at the failure of the Leader of the Council and the Cabinet Member for Finance, Property & Business Services to take into consideration the opposition of the local MP, the six Ward Councillors, and local community groups to the Cabinet decision of 14 April 2011 to make the former Golden Crescent Library surplus to requirements.

 

The Member also expressed his concern at the submission of a planning application for the site, before the Cabinet Member Decision could be implemented.

 

The Chairman after careful consideration did not agree to the Call-In of the item as the decision had been taken after consultations with interested parties at a Petition Hearing with the Cabinet Member for Finance, Property & Business Services and also the Council meeting when a Petition was also discussed.       

 

RESOLVED -    

 

1.      That the decisions made by Cabinet at their meeting on 29 September 2011 be endorsed and noted and no call-in be made of any decision. 

 

      2.   That officers be asked to provide responses to the issues outlined above.
